移民法三讀　收容外國人最多15日

現行《入出國及移民法》規定移民署可暫時收容未經許可入國，或經許可入國但已逾停留、居留或限令出國期限的外國人，此一條文經司法院釋字第708號解釋文指出違憲，將在下月6日失效。立法院院會今三讀修正通過部分條文，移民署暫時收容外國人時，最長不得超過15日。

三讀修正通過條文新增，外國人有精神障礙或罹患疾病，因收容將影響治療或有危害生命之虞；懷胎5個月以上或生產、流產未滿2個月；未滿12歲兒童；罹患傳染病防治法第3條所定傳染病；衰老或身心障礙致不能自理生活；經司法或其他機關通知限制出國等情形之一，得不暫予收容。（陳培煌／台北報導）
