廢土清運誤填日期挨罰　男反諷罰單也寫錯

劉姓砂石車司機去年7月28日傍晚開車載運廢棄土石，在新莊區中山路遭交通警員攔查，發現隨車清運文件上的日期是26日，認為劉男沒有清運文件，違反《廢棄物清理法》，劉男因此遭新北市環保局開罰6萬元，還要接受2小時環境講習教育。
 
劉男提行政訴訟表示，他僅國中夜間部畢業，原本26日就要去載運，只是附近住宅抗議，協調後才改為28日，但因疏忽未更改日期，就要重罰，讓人無法信服，劉男還強調，此屬一介小民所犯筆誤，何況就算是貴有學識的環保局，寫給他的環境講習通知單，也把車號寫錯。

新北地院考量該證明文件主要著重廢棄物產生處及載運處理地點的正確性，以方便查核，目的是用來阻絕非法棄置或不當處理，而劉男只是一時無心而誤寫日期，文件不能因此就視同無效，今判劉男勝訴，撤銷原處分；全案尚可上訴。（孫友廉／新北報導）
