「呷電ㄟ」照罰　醉漢騎電動車判刑3月

花蓮縣新城鄉1名詹姓男子，去年11月酒後騎電動自行車返家，快到家門前遭警方攔檢，辯稱：「吃電又不吃油，免戴安全帽，酒駕也不能罰我。」事後驗酒測值高達1.01毫克，遭檢警依公共危險罪法辦，花蓮地方法院日前以刑事簡易判決，判詹男有期徒刑3月，得易科罰金9萬元。花蓮縣警局交通隊長黃增樟說：「機動車輛行駛道路就不能喝酒，只要敢喝就依法開罰。」

黃增樟表示，電動機車、電動自行車在法律上屬「慢車」依照《道路交通安全處罰條例第73條》規定，酒測值0.15至0.25 毫克可開罰300元至600元；超過0.25 毫克就觸犯公共危險罪依法送辦。一般騎乘機車、汽車酒測值0.15至0.25毫克，開罰15000元至90000元，超標也依公違移送。

黃增樟說，只有騎一般單車酒駕時沒有觸犯公共危險罪疑慮，但行駛道路上仍可依慢車標準最高罰款600元。他強調，騎乘電動車代步規避酒駕是錯誤觀念，酒後最好還是搭計程車，或由未喝酒的親朋好友送回家，以免違規受罰。（王文傑／花蓮報導）
