抓漏引兇殺　殺人犯「年紀輕」免死刑

邱姓工程包商在高雄替人抓漏，屋主的林姓友人認為工程沒做好，想替屋主出氣，前年5月，林男在高雄「BAT」超商前與友人喝酒，巧遇邱姓包商，雙方起衝突，林男遭打趴壓制在地，林男心有不甘，回家拿刀從邱男背後刺殺他，邱男身中10餘刀，心臟破裂死亡，林男遭最高法院依殺人罪判刑18年確定。

判決指出，林男(26歲)與邱男打架時，屈居下風而回家拿水果刀殺害手無寸錢、毫無防備的邱男，邱男逃進超商時，林男還追入繼續砍殺，行徑兇殘，但法官考量林男血氣方剛，日後仍有教化的可塑性，雖然未賠償被害人家屬，但仍不應依檢察官要求判死刑，判18年即可。（劉志原／台北報導）
